O julgamento reformou decisão da 5ª Vara da Fazenda Pública de São Luís O jovem de 28 anos ajuizou o pedido para fornecimento do remédio, alegando não possuir meios para arcar com os medicamentos necessários para impedir o agravamento da doença, que é hereditária e neurodegenerativa e causa deformidades e perda da sensibilidade dos membros, além de complicações cardíacas e outras relacionadas. O pedido de urgência foi negado pelo juízo da 5ª Vara da Fazenda Pública, sob a justificativa de que o medicamento não está na lista do Serviço Único de Saúde (SUS), não está registrado na Agência Nacional de Vigilância Sanitária (Anvisa) e por possuir como princípio ativo a substância canabis sativa, atualmente considerada droga ilícita no Brasil. O desembargador Jorge Rachid, relator do recurso, estipulou o prazo de 10 dias para que o Estado forneça a medicação, sob pena de multa diária de R$ 10 mil. Rachid ressaltou a previsão constitucional acerca do direito de todos à saúde, cabendo ao Estado resguardar o direito à vida e ao bom tratamento físico e mental dos cidadãos, formulando e implementando políticas sociais e econômicas que assegurem o acesso universal e igualitário à assistência médico-hospitalar.
